1. Terms and conditions

1.1 Introduction

These terms govern sales in the MODERO online shop operated by the seller. The relationship between the seller and the buyer is governed by Czech law, in particular Act No. 89/2012 Coll., the Czech Civil Code. A consumer is anyone who buys outside the scope of their business.

1.2 Goods and prices

We sell new goods from clearance and end of line collections. We only have a few pieces of most models, so the offer is valid while stocks last. The number of pieces in stock is shown for every item.

Prices are final. The seller is not a VAT payer. Prices in euro and Polish zloty are converted from Czech crowns at the rate shown in the shop at the time of the order and are binding for that order.

1.3 Order and conclusion of the contract

You place an order with the button at checkout. Before sending it you can review and correct all details. The purchase contract is concluded when we accept the order, which we confirm by e-mail. The contract can be concluded in Czech, Polish or English. We archive the concluded contract electronically and it is not accessible to third parties.

If an item sells out in the meantime or the offer contains an obvious pricing error, we will let you know and cancel the order or its part. Any amount paid will be refunded without undue delay.

1.4 Payment

• Online payment by card, Apple Pay or Google Pay, and by BLIK when paying in Polish zloty, through the Stripe payment gateway. Card details are processed only by the payment gateway and never reach the seller.
• Bank transfer in advance in Czech crowns or euro to the account stated in the order confirmation. The transfer must be made within 5 days of the order, otherwise we may cancel the order.

Cash on delivery is not offered. Payment is considered made when the payment gateway or the bank confirms it.

1.5 Shipping and delivery

• Czech Republic and Slovakia: Packeta to a pickup point, Z-BOX or to your address. In the Czech Republic also PPL to your address when offered at checkout.
• Poland: InPost Paczkomat lockers or delivery to your address through Packeta.

Current shipping prices and the free shipping threshold are shown at checkout before you send the order. We dispatch goods no later than on the second working day after accepting the order, or after receiving the payment for bank transfers. The risk of damage to the goods passes to the buyer on receipt of the parcel.

2. Withdrawal from the contract

As a consumer you may withdraw from the contract without giving a reason within 14 days of receiving the goods. Simply send us a clear statement within this period, for example by e-mail or using the form below.

Please return the goods no later than 14 days after withdrawal to the seller's registered address. The cost of returning the goods is borne by you. Return the goods unworn, undamaged and, where possible, with the tags. You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature and characteristics.

We will refund the payment, including the cost of the cheapest shipping option offered, within 14 days of withdrawal using the same payment method you used, unless agreed otherwise. We may withhold the refund until we receive the goods or proof that you have sent them back.

3. Complaints

We are responsible for the goods being free of defects on receipt. As a consumer you may claim a defect that appears within 24 months of receipt. If a defect appears within the first year, it is presumed to have existed on receipt.

Wear and tear from normal use is not a defect, nor is a defect for which a lower price was expressly agreed and which we pointed out for the item.

You can make a complaint by e-mail to modero2fashion@gmail.com. Please include the order number, a description of the defect and photos, and then send the goods to the registered address. We will confirm receipt of the complaint and resolve it within 30 days at the latest, unless we agree on a longer period.

For defective goods you are entitled to repair or replacement, a reasonable price reduction, or withdrawal from the contract. As we only have a few pieces of most models, replacement is often not possible. In that case we will offer a price reduction or a refund. If the complaint is justified, we will also reimburse reasonable shipping costs.

We will issue a confirmation stating when and how the complaint was resolved.

Out of court dispute resolution

Consumer disputes can be resolved out of court through the Czech Trade Inspection Authority, adr.coi.cz. Consumers living in another EU country may also contact the European Consumer Centre in their country.

4. Privacy policy

The data controller is the seller. We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and only to the extent needed to complete your purchase.

What data and why

• Processing the order (performance of the contract): name, e-mail, phone, delivery address or pickup point, order contents, payment status. We keep them for the duration of liability for defects and the limitation period.
• Accounting (legal obligation): data on accounting documents for the period required by accounting and tax laws, usually 10 years.
• Visit statistics: we record how many times pages and items were viewed, which page you came from and what type of device you use. We do not store IP addresses or anything that could identify a visitor, and we do not use cookies for this.

In your browser we only store the contents of your cart and the selected language, and after you place an order its number until you close the window, so the payment can be completed. These are not advertising or tracking cookies.

Who receives the data

Providers the shop cannot run without: the website hosting provider (Vercel), the database provider (Supabase), the Stripe payment gateway (Stripe Payments Europe, Ltd., Ireland), the carriers Packeta and PPL, and our accountant. If data is transferred outside the European Union, this is done on the basis of standard contractual clauses or the EU-US Data Privacy Framework.

Your rights

You have the right to access, rectify and erase your data, to restrict processing, to data portability and to object. Contact us at modero2fashion@gmail.com. You may lodge a complaint with the Czech Office for Personal Data Protection, uoou.gov.cz, or with the supervisory authority in your country of residence.

5. Final provisions

The contract is governed by Czech law. This does not deprive a consumer habitually resident in another EU country of the protection afforded by the mandatory provisions of the law of that country. These terms are valid from 16 September 2026.
